Terms of Service

These Terms of Service (the "Terms") are an agreement between you and Treena Labs, Inc. ("Treena", "we", "us"). They govern your use of the treena mobile application and the cloud services that power it (together, the "Service").

1. Acceptance of these Terms

By signing in to the Service with your GitHub account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not sign in or use the Service.

By continuing to use the Service after we update these Terms, you accept the updated Terms.

2. Eligibility

You must be at least 13 years old (or 16 where required by your local law) and able to form a binding contract to use the Service. You must have a GitHub account in good standing under GitHub's own terms.

3. Your GitHub account

Sign in happens exclusively through GitHub. There is no separate Treena account or password.

When you sign in, GitHub issues Treena an access token with the "repo" and "read:user" scopes. The "repo" scope grants read and write access to all of your public and private repositories. GitHub does not offer a narrower scope for this kind of access. Treena only acts on the repositories you choose to open, but you should understand the breadth of the token you are granting.

You authorize Treena to use this token to clone, read, list, and push to your repositories on your behalf and at your direction, including the automatic backup pushes described in Section 7.

You are responsible for the security of your GitHub account. You can revoke Treena's access at any time in your GitHub settings under authorized OAuth apps. Revoking access disables the Service. Your relationship with GitHub is governed by GitHub's own terms; Treena is not affiliated with GitHub.

4. License to use the App

We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for your personal or internal business purposes on devices you own or control.

You may not reverse engineer, resell, sublicense, or scrape the Service, or use it to build a competing service, except where the law permits these activities regardless of this restriction.

If you obtained the App through the Apple App Store or TestFlight, you acknowledge that Apple is not a party to these Terms, has no obligation to provide support for the App, and is not responsible for the App or its content. Equivalent terms apply to Google Play where applicable.

5. Your content and code

You own your code. You retain all rights to your repositories, code, prompts, and any output you derive from them. Treena claims no ownership of your content.

You grant Treena only the license needed to operate the Service: to host, transmit, cache, process, display, and back up your content as part of providing the features you use. This license ends when your content is deleted from our systems, subject to the retention described in our Privacy Policy.

You represent that you have the necessary rights to the code and content you bring to the Service, including code belonging to your employer or licensed from third parties. You are solely responsible for what you store, run, and push through the Service. We have no obligation to monitor your content.

6. AI features and AI-generated content

The Service includes features powered by third-party AI models. AI output may be inaccurate, incomplete, insecure, or similar to code written by others.

You must review AI-generated code and content before relying on it, running it, committing it, or shipping it. We make no warranty that generated code is correct, secure, fit for any purpose, or non-infringing.

AI agents in the Service can execute commands and modify files in your workspace at your direction. You are responsible for the actions you approve and for the agents you run.

We do not train AI models on your content.

7. Cloud workspaces and auto-save

Cloud workspaces run on third-party infrastructure (currently Fly.io). Each workspace is a virtual machine with a persistent storage volume where the repositories you open, including private ones, are cloned at your request.

Workspace machines may be stopped, restarted, relocated, or reclaimed at any time. The Service is provided with no service level agreement and no guarantee of availability or of data durability on workspace volumes. Commit and push anything you care about.

To protect your work, the Service may automatically push your uncommitted changes to dated "treena/" branches on the GitHub repository you opened, which may be a repository owned by your organization or another user where you have write access. This includes a server-side push before a workspace shuts down, which can happen even when the App is not open. These commits and commit trailers may identify Treena as an author or co-author. You can manage and delete these branches from the storage screen in settings, and you can turn off the client-side auto-save in settings. Moving your workspace to a new region also saves uncommitted changes to a branch first, so they survive the move.

Workspace volumes persist after you sign out, as described in our Privacy Policy.

The Service is currently beta software. Features may change, break, or be discontinued at any time without notice.

8. Your AI provider keys and accounts

Some AI features use your own API keys (for example OpenRouter, OpenAI, or Anthropic keys) or your own provider accounts (for example signing in to Claude or ChatGPT for the agent engines).

These keys and accounts are yours. You are responsible for all fees your providers charge you and for complying with each provider's terms and usage policies. Treena is not responsible for provider availability, pricing, rate limits, or output.

9. MCP servers and other third-party integrations

You can connect third-party MCP servers to the Service, and repositories you open can ship their own MCP configuration that you may choose to enable.

MCP servers receive tool calls generated by AI models, which can include your code and file contents, along with any credentials you place in their configuration. They are third parties acting at your direction. Treena does not vet, endorse, or control them. Use them at your own risk, and review repository-shipped MCP configurations before enabling them.

10. Acceptable use

You agree not to use the Service, including cloud workspace machines, to:

  • mine cryptocurrency
  • launch denial of service attacks, network attacks, port scans, or spam
  • store or distribute illegal content
  • develop or distribute malware targeting third parties
  • circumvent resource limits or use workspaces as general purpose hosting
  • violate GitHub's or any AI provider's terms or acceptable use policies
  • abuse the free service through automated or excessive resource consumption

We may suspend or stop workspaces, sessions, and access that violate this section.

11. Updates and changes to the Service

App code is delivered over the air and may update automatically when you open the App. We may add, change, or remove features of the Service at any time, especially during the beta.

12. Fees and subscriptions

The Service offers a free tier and paid subscription plans. Paid plans renew automatically each billing period until cancelled. You will not be charged without affirmatively opting in to a paid plan.

Depending on your platform, payment is processed by Stripe, by Apple through your App Store account, or by Google through your Google Play account. Purchases made through the App Store or Google Play are governed by the store's own payment and refund terms, and you manage or cancel those subscriptions in your store account settings. Subscriptions purchased through Stripe can be managed and cancelled from the subscription screen in the App.

Cancelling stops future renewals; fees already paid are non-refundable except where the law or the store's policy requires otherwise. We may change plan prices or limits with notice; changes apply from your next billing period. You remain responsible for third-party costs, such as AI provider usage and your GitHub plan.

13. Termination

You can stop using the Service at any time by signing out and revoking Treena's access in your GitHub settings. You can request deletion of your server-side data as described in our Privacy Policy.

We may suspend or terminate your access if you violate these Terms, abuse the Service, or where required for legal or operational reasons, including discontinuing the beta. After termination we may delete your workspace volume and server-side data.

Sections that by their nature should survive termination (including Sections 5, 6, and 14 through 19) survive.

14. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY REGARDING: THE BETA STATUS OF THE SERVICE; THE ACCURACY OR SAFETY OF AI-GENERATED OUTPUT; THE AVAILABILITY OR CONDUCT OF THIRD-PARTY SERVICES INCLUDING GITHUB, FLY.IO, AI PROVIDERS, AND MCP SERVERS; OR THE DURABILITY OF DATA STORED ON WORKSPACE VOLUMES.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREENA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF CODE, DATA, REPOSITORIES, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREENA'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS (USD 100) OR THE AMOUNTS YOU PAID TREENA IN THE TWELVE MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold Treena harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content and code, your violation of these Terms or of third-party rights, or your use of AI providers and MCP servers.

17. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

18. Changes to these Terms

We may update these Terms from time to time. The "last updated" date at the top reflects the current version. For material changes we will provide notice in the App. Continued use of the Service after changes take effect constitutes acceptance.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. You agree to comply with applicable export control laws. We are not liable for delays or failures caused by events beyond our reasonable control. These Terms and the Privacy Policy are the entire agreement between you and Treena regarding the Service.
